High Court orders postponement of polls over candidates' unpaid bills

The High Court has ordered the Zimbabwe Electoral Commission (ZEC) to put off by-elections in some Binga wards, citing candidates’ violation of a section of the Electoral Act.

By-elections in wards 6, 8, 10, 15 and 23 of the Binga Rural District Council, which were slated for today, were called of following an urgent chamber application by Collen Mudenda, challenging the nominations of some candidates

Mudenda approached the High Court challenging the nominations of John Simunene Sikabotu, KIngson Mpofu, Mathias Mudenda, Joseph Mwembe and Wilson Siampolomba on the grounds that they were disqualified in terms of Section 119(2) (h) of the Electoral Act.

ZEC Chief Elections Officer Utoile Silaigwana said in a notice: “The section states that a person shall be disqualified from being nominated as a candidate on the nomination day or the day of an election when he or she is in default with the payment of any levy, rate, charge or tax due or payable to the council concerned for more than 120 days.

“The High Court has ordered that the Commission should not proceed with the by-election for the five wards pending the hearing of the cases which postponed (sic) to 4 January 2023.”

Silaigwana said by-elections for Binga RDC ward 20 and wards 4, 5 and 18 of the Gweru Municipality and ward 28 of Mberengwa Rural District Council will continue today as scheduled.
