Grandpa in court for grabbing estate from a minor

Agayi Munemo, 70, of Chitunwgiza appeared in court for fraudulently reselling a property after the first buyer had died and left a minor son as his heir.

Munemo, appeared before the Harare Magistrates’ Courts facing fraud charges.

The complainant is Munashe Nyazuwa, 24, of Hatcliffe son of the late Batsirai Nyazuwa.

The State alleges that on December 14, 2006, Agayi and his brother Thomas Kobo Munemo, who is already on remand over the same case, sold Lot 310, Block B, Hatfield Estate to Batsirai, Munashe’s father for $35 000 000 

Agayi, whose name appeared on the property title deeds, granted the power of attorney to Thomas who signed a written agreement of sale.

Batsirai and his wife died in 2010 without processing transfer of the property into their names.

Agaiyi then sold the property again to Masimba Kwindima and effected a deed of transfer.

Kwindima, then used legal means as the title holder to have Munashe evicted from the property.

As a result, Munashe suffered a prejudice of $35 000 000 and nothing was recovered.

The matter was postponed to July 31 when Agayi and  Thomas will appear jointly.
