Charged with criminal trespass for building on someone's land

A Msasa Park man who built his cottage on someone’s residential stand has been charged with criminal trespass as read in Section 132 (i) of the Criminal Law Codification and Reform Act, Chapter 9:23.

The accused in the matter is Phanuel Phiri, 48, while the complainant is Farai Timbe, 63.

 On July 19, 2022, Timbe, who resides in Hatfield, was allocated  a stand in New Msasa Park by Mukuvisi Tashinga Housing Cooperative. He then placed 9 000 bricks on the stand, pit sand and constructed a well as well.

On December 24, 2022, Phiri went to Timbe's stand and built a four-roomed cottage. The latter then discovered that her stand had been occupied, compelling her to report to the police.

Magistrate Evelyn Mashavakure gave Phiri a bail of ZWL $ 10 000 and he was ordered not reside at the same premises until the matter was finalised.

The case was postponed to 24 February.
