Man in Court for Selling Nonexistent Residential Stand

A Highfield man and News Homes Housing Finance have been dragged to court for allegedly selling a nonexistent residential stand to an unsuspecting buyer.

Pelcy Zindo, 39, of Highfield, and News Homes Housing Finance, represented by Sovenior Secure Bob Mukahanana of Crowhill, appeared before the Harare Magistrates’ Court facing fraud charges.

They are expected back in court on June 20.

According to prosecutor Nomsa Kangara, the incident occurred in January when the complainant saw an advert on social media indicating that News Homes Housing Finance was selling residential stands in Eyecourt, Waterfalls, Harare.

The complainant contacted Zindo using the phone number listed in the advert. She later visited the company’s offices at Zimpost Corner, Nelson Mandela Avenue and Innez Terrace, where she was attended to by Zindo. He allegedly informed her that only three stands were still available for sale.

The complainant selected stand number 3188, measuring 1,250 square metres, and priced at US$7,000.

Zindo allegedly misrepresented that upon paying a US$3,000 deposit, she would be allocated the stand and permitted to begin developments on the site. The remaining US$4,000 was to be paid in monthly instalments over 12 months.

Zindo then allegedly assigned a man identified as Dhaiton to accompany the complainant to view the stand.

On February 19, at the News Homes Housing Finance offices, the complainant handed over US$3 000 as a deposit and was issued a receipt acknowledging payment. 

The remaining balance was to be paid over 24 months.

However, when the complainant later went to clear the stand, she was informed by nearby residents and the Mvurachena Housing Cooperative management that the land in question did not belong to the accused.

All efforts to recover her money from the accused proved futile. The complainant was prejudiced of US$3 000.
