
Former Binga North MP Prince Dubeko Sibanda is confident of winning constitutional challenge against the Parliament of Zimbabwe, maintaining that his case is both strong and legally sound.
Sibanda filed the challenge in March, seeking to block parts of the Constitution of Zimbabwe Amendment (No. 3) Bill, 2026, particularly provisions that could extend the President’s term of office.
“My case is strong. I have a highly capable team of attorneys. The Respondent has failed to rebut my allegations of acting outside the provisions of the Constitution,” said Sibanda.
After receiving support on X, Sibanda remained defiant, stressing that retreat is not an option in what he views as a decisive constitutional fight.

“Sitting around mourning isn't an option. If we sit here, we will die. If we enter the camp, they will kill us. We have no option but to face our enemies. You never know, they may hear chariots of various kingdoms in their ears,” said Sibanda.
At the centre of his argument is Section 328(7) of the Constitution, which he says prevents any amendment that extends a term of office from applying to a person who already held that office before the amendment was enacted.
In the draft order attached to his court application, Sibanda asked the court to declare Clause 4(b) of the amendment bill unconstitutional and invalid. The clause seeks to apply a term extension to the continuation in office of the President, which he argues directly violates constitutional provisions.
With the matter now before the courts, Sibanda insists the legal grounds of his case place him in a strong position to secure victory
