Former MP challenges Zimbabwe Term-Extension Bill

Former Binga North  MP  and legal practitioner, Prince Dubeko Sibanda, has filed an constitutional challenge against the Parliament of Zimbabwe, seeking to block parts of the proposed Constitution of Zimbabwe Amendment (No. 3) Bill, 2026.

Court papers  showed that Sibanda is arguing that sections of the amendment bill are unconstitutional and violate existing provisions of the Constitution.

In the founding affidavit, Sibanda describes himself as a Zimbabwean citizen, registered voter, former legislator for Binga North, and a registered legal practitioner. He states that he is bringing the application in his personal capacity to protect constitutional principles governing amendments to the country’s supreme law.

Sibanda contends that the proposed amendments attempt to extend the term of a sitting president in a manner that contradicts constitutional safeguards.

“The Respondent’s authority to amend the Constitution is exercisable only in accordance with section 328 of the Constitution,” the application states.

The former MP further argues that Section 328(7) of the Constitution prevents any amendment that extends a term of office from applying to a person who already held that office before the amendment was enacted.

In the draft order attached to the court application, Sibanda asks the court to declare that Clause 4(b) of the amendment bill, which seeks to apply a term extension to the continuation in office of the President, is unconstitutional and invalid.

“It is hereby declared that Clause 4(b) of the Constitution of Zimbabwe Amendment (No. 3) Bill, 2026… is constitutionally incompetent, unlawful, and of no force or effect,” the draft order reads.

The application also challenges another provision in the bill, Clause 9(b), arguing that it similarly conflicts with constitutional provisions governing amendments.
