A Southlea Park man has appeared in court for defrauding US$25 500 after leading his victim to believe that he would facilitate the importation of four vehicles from Japan.
Liberty Katayi, 34, of Southlea Park appeared at the Harare Magistrates' Court sued for fraud as he violated Section 136 (a) (b) of the Criminal Law Codification and Reform Act, Chapter 9:23.
The court heard that in June 2022, Katayi and Damain Jack - who is already on remand facing a similar charge were given US$25 500 meant to import four cars, three Toyota Hiace-Baby Quantum and Toyota Axio from Japan through Be Forward on behalf of the complainant.
Instead of purchasing the cars, Katayi and his accomplice took the money and used it for their own purposes.
As a result, the complainant lost an amount of US$25 500 in the process.
Katayi who appeared in front of magistrate Dennis Mangosi was remanded out of custody to January 31.
In another case involving vehicle sales, a Dzivarasekwa man also appeared in court facing charges of defrauding a client of US$3 250.
Success Muzonyei, 36, of Dzivarasekwa was before the Harare Magistrates' Court charged with fraud violating Section 136 of the Criminal Law Codification and Reform Act, Chapter 9:23.
The court heard that the complainant Simbarashe Mhako, 52, a pastor at the Seventh Day Adventist Church in Kwekwe decided to sell his car, a Ford Ranger. He engaged identified as Elias Rugube in Harare and the two agreed that the vehicle would be sold for US$6 000.
Mhako left the car in the custody of Rugube. Rugube then engaged Muzonyei to find a buyer for the vehicle. Muzonyei is a used car dealer in Kuwadzana.
On 18 August 2021, Muzonyei sold the vehicle to one Mr Chauke for US$7 000.
Muzonyei and Rugube entered into a fraudulent agreement of sale in which Muzonyei posed as the buyer of the car and paid US$3 000 plus a Nissan Terrano vehicle.
Mhako later returned the Terrano to Muzonyei as the vehicle had proven to be defective. The two entered a new agreement under which Muzonyei agreed to pay Mhako US$3 250 before 30 January 2021.
Mhako did some investigations and discovered that Muzonyei had sold the car to Chauke for US$7 000
He made efforts to engage Muzonyei to recover his outstanding balance as per second agreement, but Muzonyei became evasive.
As a result Mhako lost US$3 250 and reported the matter to the police.
Muzonyei was before Presiding magistrate Mr Dennis Mangosi granted Muzonyei ZWL$30 000 bail and remanded him to March 16.
