Miners Accused of US$30m Plot to Take Over Filabusi Mining Claims

 

Two Bulawayo miners have been accused of fraud after allegedly using false representations to gain control of a mining company and its Filabusi mining claims valued at approximately US$30 million.

John Farley Pietersen, 66, and Peter Mark Johnstone, 58, are facing fraud charges stemming from allegations that they unlawfully secured ownership and control of All Aflame Marketing (Pvt) Ltd and its Royal Family Claims in Filabusi.

According to the State, DGL Finance Limited, a Mauritius-registered company, is the sole shareholder of All Aflame Marketing through its holding of 170 ordinary shares. The complaint was lodged by executive director David Peter Easterbrook and Allan Brent Dolan, who allege they were unlawfully removed as directors of the company.

Prosecutors allege that Pietersen and Johnstone misled the High Court by claiming that legal papers had been properly served on All Aflame Marketing despite knowing the company no longer operated from the address where the documents were delivered.

The State contends that the alleged misrepresentation resulted in the matter being treated as unopposed, leading to a default judgment that enabled the pair to acquire a 57.45 percent shareholding in the company.

Prosecutors further allege that the two men later submitted a High Court order to the Registrar of Companies and falsely represented that Easterbrook and Dolan had resigned as directors. Acting on the information, company records were amended to reflect Pietersen and Johnstone as directors while removing the complainants.

The State maintains that the complainants never resigned and that the accused knowingly provided false information to gain control of the company and its mining assets.

The alleged prejudice arising from the transactions is estimated at about US$30 million.

Pietersen and Johnstone were granted US$500 bail each and are expected back in court on July 24, 2026.
