Two in court for selling same stand to different buyers

Two Chitungwiza men who sold the same stand to two buyers appeared before the Harare Magistrates' Court charged with contravening Section 136 of the Criminal Law Codification and Reform Act Chapter 9:23, or alternatively fraud

The state alleges that on October 27, 2022, Shoniwa Gwese, Taurai Chivanga and the third accused person only known as Banda who is still at large, lied to the complainant Fanuel Makurumure that Chivanga owned a 1000 square meters stand located at number 18631 Rockview West Chitungwiza.

The stand was said to have been on sale and it is alleged the selling price was pegged at US$6 000.

On the same day Makurumure paid US$4 500 to the three accused persons as deposit.

Gwese wrote an affidavit statement confirming receiving the money.

Chivanga prepared an agreement of sale which was between the Chivanga family, land developers and Makurumure.

On November 23, 2022, Makurumure paid US$1 200 to Chivanga who wrote an affidavit statement confirming receiving the money.

When the three sold the stand, number 18631 Rockview West Chitungwiza, they knew very well that Chivanga had already sold the same stand to Majoni Tichaona who gave him a Toyota Sprinter valued at US$4 500 as payment.

The two appeared before magistrate Dennis Mangosi who remanded them out of custody to  March 23 pending finalisation of investigations.
